NEW ROUND OF SECTION 301 CHINA TARIFF EXCLUSIONS & SECTION 232 TARIFFS FOR STEEL AND ALUMINUM

On November 26, 2019 the Office of the U.S. Trade Representative (USTR) (84 FR 65,882 of November 29, 2019) granting 32 exclusion requests to the Section 301 duties levied on goods from China. See our updated EXCLUSION LIST, which includes all exclusions granted to date. The notice affects goods on List 3 and includes candy lollipops (not containing cocoa), plastic trays, foldable stepladders, vacuum cleaners, bicycles and other items. These exclusions apply from September 24, 2018 through August 7, 2020. The applicable HTS to apply to this round of exclusions is 9903.88.35.
This notice also modified U.S. note 20(ll)(23) to subchapter III of chapter 99 of the HTSUS by deleting “Articulated chains of iron, not over 8 mm in thickness and valued not over $2 per kg (described in statistical reporting number 7315.12.0080)” and inserting “Articulated chains of iron, not over 8 mm in thickness and valued not over $2 per m (described in statistical reporting number 7315.12.0080)” in lieu thereof.
Reminders
The List 4A Portal for Exclusion Process opened October 31, 2019 and closes on January 31, 2020 at 11:59pm. This exclusion process is for products covered by Annex A (84 FR 57145 of October 24, 2019). The Federal Register notice sets out specific procedures for submitting requests.
Return of 232 Tariffs on Steel and Aluminum from Brazil and Argentina
President Trump tweeted on December 2, 2019 that effective immediately he was restoring the 232 tariffs on all steel and aluminum shipped into the U.S. from Brazil and Argentina.
