USTR issued a Federal Register Notice (FRN) this week extending some of the previously granted 301 China tariff exclusions – the FRN can be found here.
Note that USTR only extended 266 of 960 previously granted exclusions. Previously granted exclusions expired August 7.
USTR also issued additional List 4A exclusions this week – the FRN announcing additional List 4A tariff exclusions can be found here. Note that these exclusions expire on September 1, along with all other List 4A exclusions. USTR issued an FRN seeking comment on extending List 4A exclusions – that FRN can be found here.
Given that USTR only extended 28% percent of all List 3 exclusions, we strongly suggest that any company looking to have their List 4A exclusion/s extended beyond September 1 submit comments to USTR. With that being said, companies should expect that any List 4A exclusions that are extended will only be extended to December 31, 2020, to align with the expiration of virtually all other exclusions from Lists 1, 2 and 3.
